Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Truthly mobile application, website, and related services (collectively, the “Services”) operated by Truthly, Inc. (“Truthly”, “we”, “our”, or “us”). By creating an account or otherwise using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to create an account or use the Services. If you are under the age of majority where you live, you may only use the Services with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

The Services are operated from the United States. You are responsible for ensuring that your use of the Services complies with the laws of the jurisdiction in which you live.

2. Accounts

To use most features of the Services you must create an account. You agree to provide accurate and current information, to keep your credentials confidential, and to notify us promptly of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or legal risk.

3. Subscriptions and payments

Certain features of the Services require a paid subscription. Subscriptions are billed through Apple In-App Purchase or Google Play Billing, subject to the terms of those platforms. Truthly does not process payment information directly.

Subscriptions renew automatically until canceled. You may cancel a subscription at any time through your Apple or Google account settings. Refunds, where available, are governed by the platform's refund policy.

We may change subscription pricing or feature availability with notice. Any change takes effect at the start of your next billing cycle.

4. Acceptable use

You agree not to:

  • Use the Services to violate any law or third-party right;
  • Reverse-engineer, scrape, or attempt to extract the source code, models, or training data of the Services;
  • Use the Services to generate or distribute content that is harassing, defamatory, hateful, sexually explicit, or that promotes violence or self-harm;
  • Attempt to bypass any security, rate-limiting, or content moderation mechanism;
  • Use the Services to build, train, or improve any competing AI model or product;
  • Resell, redistribute, or expose the Services as your own product or API.

5. AI-generated content

The Services use artificial intelligence to generate responses, summaries, and other content (“AI Output”). AI Output is generated by software and may contain inaccuracies, omissions, or errors, even when grounded in trusted sources such as Scripture and the Catechism.

Truthly is a study and discernment aid. It is not a substitute for the sacraments, for the pastoral care of an ordained minister, or for professional advice in matters of health, finance, law, or psychology. You should not rely on AI Output as the sole basis for any decision in those areas.

You are responsible for reviewing AI Output before acting on it, sharing it, or representing it as authoritative.

6. Your content

You retain ownership of the questions, prompts, and other content you submit to the Services (“User Content”). You grant Truthly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process User Content solely to provide and improve the Services.

We do not sell User Content. Access to User Content within Truthly is limited as described in our Privacy Policy.

7. Intellectual property

Truthly, the Truthly name, logo, app design, source code, and AI Output produced for you within the Services are owned by Truthly, Inc. or our licensors. Except for the rights expressly granted in these Terms, no license is granted to you in any of our intellectual property.

References to Scripture, the Catechism of the Catholic Church, conciliar documents, papal teaching, the writings of saints, and other sources of Catholic tradition remain the property of their respective rights holders. Truthly makes no claim of ownership over these works.

8. Third-party services

The Services may link to or interoperate with third-party services (such as Apple, Google, and analytics providers). Your use of those services is governed by their own terms and privacy policies, and Truthly is not responsible for their content or practices.

9. Termination

You may stop using the Services and delete your account at any time through the in-app settings or by contacting us via the Contact form.

We may suspend or terminate your access to the Services at any time if you violate these Terms, if required by law, or if we discontinue the Services. Upon termination, the license granted to you in these Terms ends and any data retention follows our Privacy Policy and applicable law.

10. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Truthly does not warrant that the Services will be uninterrupted, secure, error-free, or that AI Output will be accurate or complete.

11. Limitation of liability

To the maximum extent permitted by law, Truthly and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from or related to your use of the Services.

Truthly's total liability for any claim arising out of or relating to these Terms or the Services is limited to the greater of (a) the amounts you paid to Truthly in the twelve months preceding the claim and (b) one hundred U.S. dollars.

12. Indemnification

You agree to indemnify and hold harmless Truthly and its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of laws principles. The state and federal courts located in Mecklenburg County, North Carolina will have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by updating the Effective date above and, where appropriate, by notifying you in the Services or by email. Your continued use of the Services after the changes take effect constitutes your acceptance of the updated Terms.
